This Agreement is made between CUA LLC and its customers. The Parties agree that this is a monthly Service Contract. Customer agrees to pay CUA LLC monthly in advance of the services to be provided that month. The Parties agree that in the event Customer fails to pay in advance of service being provided as required by this Agreement, the contract shall be terminated and Customer shall be required to pay the pool service fee for one month as liquidated damages.
CUA LLC will provide pool service once a week at the Customer’s address. We will refill and balance your pool once every 4 to 8 weeks. Customer agrees to pay a monthly pool service fee of $94.99 plus tax in advance each month for the service. Service starts on first pool balancing visit, will be performed withing the first 10 days sign up fee is collected. Pools over 25,000 gallons will be charge up to $10 a month for every additional 5,000 Gallons.
CUA LLC will provide the same service as on “Chemical Only” service level plus the following services. Netting, Brushing, Cleaning Skimmers, Cleaning Automatic Vacuum and Vacuum the pool. Customer can opt one of the following frequencies: Every Week ($229.99), Every Other Week ($159.99) , Every 3rd Week ($139.99), Every 4rd Week ($119.99). The customer also have the option of on-demand cleaning for $55.
The Parties agree that circumstances can arise that affect or prevent CUA LLC from performing pool and/or spa maintenance such as the weather, an illness, or a holiday. In such event, CUA LLC may elect to postpone pool and spa service for one week, not to exceed 5 weeks each year.
In the event of inclement weather on the scheduled date of service, the pool and spa will be cleaned to the extent weather permits.
Customer must ensure CUA LLC has access to the service area on the scheduled service day, including: gate entry codes, lock combinations, security guard verification, and pets relocated from pool/spa area. If CUA LLC is unable to access the service area for any reason, services will not be performed that week and Customer shall not be entitled to a credit.
CUA LLC will be closed 10 days a year and service will not be provided as follows:
New Year’s Day
• Washington’s/Presidents Day
• Memorial Day
• Independence Day
• Labor Day
• Thanksgiving
• Day After Thanksgiving
• Christmas Eve
• Christmas
• New Year’s Eve
These dates are already accounted for in calculating the monthly service fee. Therefore, no credit is due. In the event of an emergency, CUA will make every effort to return your calls and answer emails. Emergency services are provided at a separate agreed upon rate quoted on a case by case basis.
CUA shall provide the following services each Cleaning Day:
Pool vacuumed as needed
• Pool surface skimmed as needed
• Clean Skimmer baskets
• Clean Pump baskets
• Pool equipment operation inspected
• Pool walls, floor, and tile to be brushed as needed
CUA Pools will only remove debris that was already in the pool prior to our arrival. Cleaning service is billed at a rate of up to 30 minutes of active cleaning, with an optional extra 30 minutes for a $25 fee needed I.E. Storm Cleanup, Excessive Debris, and any other situations out of the normal scope of work for your swimming pool. If the pool cleaning is en excess of 60 minutes a custom plan to bring the pool to back to normal will be created by our Service Manager.

CUA Pools is NOT responsible for keeping water levels and skimmers free of debris during the week. Recommended water level is MID-TILE. We will inspect the equipment and clean the Filter Pump basket as needed.
Pools Shall be filled by the customer. An employee may start filling the pool during a visit and leave the pool refilling on costumer authorization. CUA is NOT responsible for pool overflow or any water bill resulting from pool refills.
Customer with “Chemical Only” agrees to keep the the pool clean and free of debris, including skimmers. CUA reserves the right to perform an on-demand cleaning if there is excessive amount of debris on the pool and bill the customer at the rated state on this agreement.
In some pools, CUA LLC may opt to add a mineral conditioner to protect the chlorine and/or control algae. Customer agrees not to remove the unit from the pool skimmers or pump basket. In the event of a removal a $100 fee will due.
In the event of the pool developing algae, CUA LLC will make any reasonable effort to bring pool to normal including chemical balance, brushing and pool cleaning. This benefits is only available to customers with a functional equipment that meets the needs of the given pool and has been running the recommended daily time for the past 30 days. Only customers with a filter cleaning plan qualify for the Green Guarantee.
Filter cleaning is NOT included as a monthly service. DE Filters shall be cleaned every 6 months (Pre-Approved $100, OnDemand $150) and Cartridge Filters shall cleaned every 3 months (Pre-Approved $100, OnDemand $150). The customer has the option to pay an additional $24.99 a month to include the Filter Cleaning on the monthly service. Filters MUST be properly maintained in order for CUA LLC to perform proper maintenance service.
Filter backwash is NOT included as a monthly service. Filter backwash will be perform every 4 to 8 weeks for an additional charge (Pre-Approved $15, OnDemand $35). Backwash are included with the optional $24.99 a month filter cleaning package.
Repairs are not included in the monthly service fee. Service calls fee is $55, will be waive if the issue is directly a result of CUA Services or Equipment. Repairs under $100 will be performed immediately and charged separately to the Customer. Repairs greater than $100 shall require Customer authorization in advance of the repair.
Customer agrees to pay CUA LLC the monthly service fee stated above as well as any additional costs that may be incurred for repairs or services that are in addition to the services specified above. Additionally, Customer shall incur an additional charge for filter cleaning.
Customer agrees to provide CUA LLC with easy access to the property. If the property is locked, customer should share the code or open the gate before the technical arrives to the property. We will wait no more than 5 minutes to gain access. CUA LLC can not guarantee that there will be time to come back on that week if schedule is full. Repeat failure to comply will result on a $35 trip charge for each failed attempt. CUA LLC shall provide a 4 digit combo lock ($10 fee) at customer request.
CUA LLC accepts Credit/Debit Card, payment only. Each monthly payment must be received by CUA LLC, in full, before the FIRST scheduled service for that month. For example, the monthly payment for October service must be received by CUA LLC before Customer’s first scheduled service for October. If the card on file does not cover payment of the monthly service fee, and any additional charges that may become due and payable, Customer shall be in default. In the event of default, services will be postponed and Customer will assessed a late fee penalty of $25. If Customer fails to cure the default, the Parties agree that CUA LLC shall suffer liquidated damages as a result of the Customer’s default in the amount of $25 per week or one (1) additional month’s service fee, whichever is less. Customer agrees that the liquidated damages are in addition to the monthly service fee that remains due and payable and are intended to compensate CUA LLC for damages suffered as a result of the inability of CUA LLC to anticipate Customer’s default and immediately fill the void created by the default with a new customer. Credit Cards will be left on file and automatically deducted each month.
The service requires internet access to remotely monitor the pool. Customer agrees to provide a reliable Internet Access using 2.5 ghz WiFi. If the WiFi signal is not stable we will add a WiFi extender for $60 and/or a WiFi router for $80. In the event that the system is offline our tech will stop on a weekly basis. If the system is offline for more than two consecutive weeks we may charge the customer an additional $20 a month until the Internet Access is restore.

ALL credit card information will be kept on file and held for use by CUA LLC only. By providing this information, Customer is authorizing CUA LLC to charge the Card on File for all services provided to Customer by CUA LLC pursuant to this Pool Service Agreement.
CUA LLC shall not be responsible for any damage to property due to acts of nature, fire, vandalism, misuse, or abuse. Customer should be aware of normal deterioration of equipment that occurs over time due to exposure to chemicals, sunlight, and, in some cases, other corrosive materials (i.e., salt). The CUSTOMER is responsible for maintaining correct water levels at all times. Also, CUA LLC is not responsible for any damages or deterioration caused by failure of a Customer to perform other services recommended by CUA LLC, or by failure of Customer to properly maintain the pool and equipment between visits.
CUA LLC shall not be held liable for any damage to turf, landscaping, or other exterior features surrounding the pool area resulting from routine pool maintenance, chemical applications, or the normal wear and tear associated with such services. Customer acknowledges that certain pool maintenance chemicals may inadvertently affect surrounding landscaping, and it is the Customer’s responsibility to implement adequate protective measures for these areas.
The Parties agree that this Agreement is a monthly service agreement that continues from month to month until terminated. The Agreement may be terminated by either Party. However, the Parties further agree that Customer shall give CUA Pools thirty (30) days advance written notice of Customer’s termination of this Pool Service Agreement. Such written notice may be delivered in person, by email, or at the offices of CUA LLC.
Equipment provided by CUA LCC is leased to the client while service is Active. If any damage is done to our equipment, customer agrees to pay $800 to CUA LLC.
All balance in the account has to be paid withing 30 days of termination. Failure will result is a 2% monthly interest plus $25 monthly collection fee for each month that the balance is not paid.
The Parties agree that any future disputes between them arising under this Agreement shall be submitted to a half day mediation before a former or retired Denton County District Judge or an agreed upon mediator. The mediation shall take place in Denton County, Texas. This Agreement shall be construed and is governed under the laws of the State of Texas.
